Privacy Policy

Welcome to the Ellen Ehli Art website (“EEA,” “my,” “we,” “us,” or “our”).

EEA is committed to protecting its users’ privacy. The EEA Privacy Policy (“Policy”) is designed to help you understand how we collect, use and safeguard the information you provide to us, and to assist you in making informed decisions when using our Service.

This Policy applies to your use of https://ellenehliart.com/ (the “Site”) and any other related webpages, services, applications, or functionalities. By visiting, uploading, or otherwise interacting with the Site you are subject to this Policy. If any material changes are made to this Privacy Policy, we will notify you by posting a revised Privacy Policy on the Website or notifying you through the Website.

ANY ACCESS OR USE OF THE WEBSITE BY YOU SUBSEQUENT TO THE EFFECT DATE OF SUCH CHANGES SHALL CONSTITUTE AND BE DEEMED YOUR AGREEMENT TO THIS PRIVACY POLICY.

Accordingly, we encourage you to review periodically this Privacy Policy and the Website as a mean by which to keep informed of our current privacy practices. If you do not agree to our privacy practices as detailed here, please do not use this Website.

We ask that you please read this policy carefully, in particular immediately prior to providing personal information or submissions to us.  This policy addresses the following:-

1.    Information We Collect

Personally Identifiable Information

Personally Identifiable Information (“PII”) is any information that can be used to identify you — such as your first and last name, your email address, your physical address, or phone number.

We collect whatever personal data about you that you choose to give us, such as contact email addresses and profile information. If you give us an email address, we may send you informational or promotional messages periodically.  We will try to ensure they are helpful, engaging and interesting but of course you may opt out at any time using the unsubscribe information contained in the email.

Derivative Data

(non-personally identifiable information)

EEA may, from time to time, automatically collect aggregate information about our visitors. Some of this information may be collected automatically by the platform on which our site is hosted.  We may, as a result, end up providing this visitor information to our advertisers, sponsors, business and promotional partners and affiliates. This aggregate information includes, but is not limited to, 1/ IP addresses connecting to our site, 2/ how many persons visited a particular page or activity, 3/ dates and times of image uploads, 4/ device characteristics, 5/ operating system, 6/ browser type and version, 7/ type of connection, 8/ page and image viewing statistics, and 9/ incoming and outgoing links.

As with most websites, log files are used to store this information. None of this automatically-collected technical information is associated with any identified person at the time it is collected.  However, it could be associated with you under at least two circumstances:

First, if you elect to provide us with personal data about you as described above.  In this case the technical information we collect that would otherwise be anonymous could instead be logged as having come from you.

Second, if we are required by law to disclose our server logs as a result of a subpoena or other legal process, some third party such as your internet provider could match our anonymous technical information with you, in that case likely using information beyond what is retrieved from on our servers.

Financial Data

Financial information includes data related to your payment method (for example: credit card number, card type, expiration date) that we may collect when you purchase, order, return, exchange, or request information about our services from the site. We endeavor to store only very limited, if any, of the financial information collected. Otherwise, all financial information is stored by our payment processor(s) [variously, Stripe, Amazon Payments, Authorize.Net, Google Checkout, PayPal, or other third-party payment companies — and you are encouraged to review their privacy policies and contact them directly with any questions.]

Cookies

EEA may use cookies, pixel tags, web beacons, web server logs, or other anonymous tracking information to improve our server's interaction with your computer.  In addition, we may partner with third party sites or advertisers who may (themselves or through their partners) place or recognize a unique cookie on your browser. These cookies enable more customized content, services or advertisements to be provided to you. To activate these cookies, we may pass an encrypted or ‘hashed' (non-human readable) identifier corresponding to your address to a Web advertising partner, who may in turn place a cookie on your computer. No personally identifiable information is on, or connected to, these cookies. Although our servers may not respond to "do-not-track" requests, you may block these cookies in other ways such as by searching for “[your own browser] + disable cookies” through an online search engine.

2.    Information Use & Disclosure

EEA will never share, sell, lease, or rent PII to unaffiliated third parties, except in the following circumstances:

[a]  The processing of transactions including processing payments and shipping, and conduct of our business. Further to this, we may use such information to fulfill and manage purchases, orders, payments and other transactions on the site. We may email you to communicate about your order, notify you of offers, request feedback, troubleshoot problems and respond to service requests.

We may also share such information with companies that provide support services to us, such as a printers, mailing houses, fulfillment-companies, credit card processors, email service providers or web hosts, amongst others. These parties may need personal information about you in order to perform their functions. However, these parties may not use any personal information we share with them about you for any other purpose other than in connection with performing supporting functions for us.

[b]  Having a good faith belief that we must disclose such information for legal reasons, such as to enforce our Terms of Service, protect or assert the rights, property interests, or personal safety of EEA (including its employees, directors, suppliers, distributors, affiliates, service providers, users of the Website or others), or if we are otherwise required to disclose such information by law. In this case, we will disclose information only to the extent necessary to comply with the purpose of the request.

[c]  The sharing of aggregate, anonymous or summary information concerning our customers and their behaviors with partners, advertisers or other third parties. This data would not contain personal information and consequently would not identify you personally.

3.    Protection of Your Information

EEA has consciously implemented certain administrative, technical, and physical security measures to help protect your PII. While we have taken reasonable steps to secure the personal information you provide to us, please be aware that despite our best efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed 100% against any interception or other type of misuse. Information disclosed online is vulnerable to interception and misuse by unauthorized parties. Consequently, we cannot guarantee complete security if you provide personal information. You can take safety precautions to prevent unauthorized access to your information such as by limiting access to your computerized device(s).

4.    Your Rights Regarding The Use Of Your Personal Information

You have the right at any time to prevent us from contacting you for marketing purposes.  If and when we send a promotional communication to a user, the user can opt out of further promotional communications by following the unsubscribe instructions provided in each promotional e-mail. Please note that notwithstanding the promotional preferences you indicate by unsubscribing or opting out in some other fashion, we may continue to send you administrative emails including, for example, periodic updates to our Privacy Policy.

5.    California Online Privacy Protection Act

CalOPPA requires all commercial websites and online services accessible by California residences to post conspicuously a privacy policy. In accordance with CalOPPA, we agree to the following:  1/ Users can visit our site anonymously;  2/  Users will be notified of any privacy policy changes on our Privacy Policy page; and 3/  Users are able to change their personal information by emailing us directly through the Contact Page here on this website.

6.    Children’s Online Privacy Protection Act (COPPA)

EEA does not knowingly collect PII from children under the age of thirteen (13). If you are under the age of thirteen (13) then you should not provide us with any personally identifiable information. Furthermore, if we learn that we have collected any information or content from anyone under the age of 13, we will delete that information immediately.

8.  Controls for Do-Not-Track Features

Most web browsers and some mobile operating systems include a Do-Not-Track (“DNT”) feature (or setting you can activate) to signal your privacy preference to not have data about your online browsing activities monitored and collected. However, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As a result, we do not currently respond to specific DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a universal standard for online tracking is adopted that we must follow in the future, we will implement new standards and inform you about that practice in a revised version of this Privacy Policy.

9. Anti-SPAM Policy

EEA is opposed to unsolicited commercial email (‘spam’). We do not intend to send unsolicited marketing emails to anyone without their permission and we do not sell or provide user email addresses to any unauthorized third party in violation of this Policy. Newsletters and other general email marketing communications will also include "unsubscribe" opt-out information that you may use to tell us to stop sending you marketing emails.

10.   Sharing of Information with Partners

As stated above, we may collect and provide aggregate information about our visitors to our advertisers, sponsors, business and promotional partners, and affiliates.

We may use third-party advertisers to deliver online advertising. These companies facilitate the delivery of ads, conduct market research, and use cookies for record-keeping purposes. These cookies sometimes enable the companies to serve you ads tailored to things you have shown an interest in based on your prior web activity. This means that, for example, if you frequently read movie reviews online, it is possible that you might see ads on other websites relating to upcoming movies.

Online advertising companies generally conduct this activity in an anonymous format, with online information not combined with information that would allow for your identification.

The third-party organizations that may be serving advertisements on EEA may include companies like Google. If you would like more information about the collection, use and disclosure practices of these companies, and/or your options for not having this information used by these companies, click on the company names above any such ads and follow the links to the respective company’s website.

11.  Changes to our Privacy Policy

We may, periodically, modify, alter, or update this Policy. We will alert users to any material changes to this policy by posting the revised information here. We encourage you to review our Privacy Policy on a regular basis to stay informed about how we are protecting the personal information we collect.

Your continued use of EEA’s website constitutes your agreement to this Privacy Policy and any future updates.

12.  Contact Information
